PRIVACY POLICY

WE VALUE YOUR PRIVACY NadFun is committed to protecting and respecting the privacy of its Users. This Privacy Policy (“Policy”) explains in detail how we collect, use, store, disclose, and otherwise process certain information and data obtained from Users when they access or interact with our Services. This Policy forms an integral part of, and is incorporated by reference into, our Terms of Use.

By acknowledging this Policy during your account registration process, and by continuing to access or use the Services thereafter, you affirm that you have read, understood, and agreed to be bound by the terms and conditions set out in this Policy.

Unless otherwise expressly defined within this Policy, all capitalized terms shall have the meanings assigned to them in our Terms of Use.

WHAT TYPE OF DATA WE COLLECT?

We do not create, maintain, or manage user accounts, nor do we collect or store personally identifying information such as your name or Internet Protocol address. When you interact with the Interface, only the following limited categories of data (“Data”) are collected:

• Public Blockchain Data: When you connect your non-custodial blockchain wallet to the Interface, we record your publicly visible blockchain address. This enables us to assess usage patterns and conduct wallet-screening checks for potential prior illicit activity using insights from reputable blockchain analytics providers. Blockchain addresses are inherently public, self-generated, and not issued or assigned by us or any central authority, and they do not inherently identify any natural person.

• Data From Third-Party Sources: To comply with legal obligations and protect the Services from fraud or illicit activity, we may work with external service providers who may obtain information related to your wallet address or transactions conducted through the Services.

• Survey and Usability Data: If you participate in a survey or usability study, we may record any biographical information you voluntarily provide (such as your name, email address, or job title), as well as your responses and engagement with the survey or study.

• Communications Data: We may store communications you send to us via email, social media, or other channels (e.g., Twitter or Discord), including submissions made through surveys, forms, or questionnaires.

• Voluntarily Provided Information: If you choose to provide optional information (for example, an email address), we will use it solely for the purpose disclosed at the time of submission. We will not attempt to link such information to your wallet address, IP address, or other identifiers. Providing such information is entirely optional and not required to use the Services.

• Cookies: We may collect information through automated technologies such as cookies, web beacons, and server logs. By using the Services, you consent to our use of cookies, beacons, and similar technologies in your browser and within emails, consistent with this Policy.

HOW DO WE USE THE DATA WE COLLECT?

• Providing, maintaining, customizing, and enhancing the Services: We use Data to operate the Services effectively, ensure their stability and functionality, tailor certain features to improve your overall experience, and develop new tools or capabilities over time.

WHEN AND WITH WHOM DO WE SHARE THE DATA WE COLLECT?

We do not rent, sell, or disclose your Data to third parties except as outlined in this Policy. We may share your Data in the following circumstances:

• Service Providers: We may share your Data with third-party service providers that assist us with functions such as hosting, data analytics, email delivery, support services, and other operational tasks that help us provide, maintain, and enhance the Services.

• Business Transactions: Your Data may be shared with a potential or actual acquirer, successor, assignee, or other entity in connection with any corporate transaction, including a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of assets (including in bankruptcy or similar proceedings).

• Security and Fraud Prevention: We may disclose Data to detect, investigate, prevent, or stop fraudulent, unauthorized, or illegal activities, to address security vulnerabilities or technical issues, and to protect NadFun ecosystem, Users, and the broader ecosystem.

• With Your Consent: We may share your Data in any situation where you have expressly authorized us to do so.

Additionally, we may work with third-party analytics providers to help us better understand how the Services are used. Although we do not provide these analytics vendors with your Data, they may set and access their own cookies, pixel tags, or similar technologies on the Services and may collect Data about your online activity over time and across different websites.

We may also use or share aggregated or de-identified Data that does not identify any individual for any lawful purpose, unless restricted by applicable law.

THIRD-PARTY SERVICES AND SITES

The Service may feature content provided by third parties. Such third-party content may employ cookies, web beacons, or other technologies to collect Data when you view or interact with it on the Service.

It is important to understand that transmitting Data over the internet always carries some level of risk. The Services may also incorporate third-party technologies, features, or functionalities, such as hyperlinks to external websites, platforms, or resources that are not owned or managed by us. HOW WE PROTECT YOUR DATA

We employ and maintain reasonable administrative, physical, and technical safeguards designed to protect Data from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee the absolute security of any Data you provide.

You are responsible for all activity associated with your use of the Interface, including the security of your blockchain addresses, cryptocurrency wallets, and their associated cryptographic keys.

You acknowledge and accept that no Data transmission or storage system can be entirely secure. While we make reasonable efforts to safeguard your Data, we cannot warrant or guarantee its complete security or privacy, and any transmission or sharing of Data through the Service is done at your own risk.

HOW LONG DO WE KEEP YOUR DATA?

We will retain your Data for as long as it is reasonably necessary to provide and maintain our Services, and to fulfill any legal, regulatory, or contractual obligations, including those related to financial transactions. Data may also be retained to resolve disputes, enforce our policies, or protect our rights and the rights of others. The retention period for each category of Data will be determined based on the type of Data collected, the purposes for which it is processed, and the applicable legal or regulatory requirements, while ensuring that outdated or unnecessary Data is securely deleted at the earliest reasonable opportunity.

NO USE OF SERVICES BY MINORS

The Services are intended for a general adult audience and are not directed at children. We do not knowingly collect Data (as defined under applicable laws, including the U.S. Children’s Online Privacy Protection Act, or “COPPA”) from anyone under the age of 18.

CROSS-BORDER DATA TRANSFER

Please be aware that your Data may be transferred outside your region for storage or processing in various locations worldwide. By using the Service, you consent to the transfer of Data to countries other than your country of residence, which may have data protection laws that differ from those in your jurisdiction.

Through your continued use of the Service, you agree to the terms and conditions of this Risk Disclosure. In this Risk Disclosure, unless specifically defined herein, any capitalized terms shall have the meanings ascribed to them in our Terms of Use.

1. Market and Financial Risks

· Digital assets, including meme-coins, tokens, or other blockchain-based instruments, are highly speculative and volatile. Prices can fluctuate dramatically over short periods, and markets may be illiquid or unpredictable.

· You may lose all or part of the digital assets you trade, hold, or invest in through the Interface.

· Past performance is not indicative of future results, and NadFun does not provide investment, financial, legal, or tax advice.

· You are responsible for evaluating the financial, market, and other risks associated with your use of the Services and Interface.

· NadFun does not guarantee the liquidity or market price of any of any crypto assets on the Interface. Any market for any of the crypto assets may abruptly appear and disappear. NadFun makes no representation or warranties about the future market price of any of your crypto assets.

2. Blockchain and Smart Contract Risks

· Transactions on the Interface rely on blockchain networks, which may experience failures, congestion, delays, or security vulnerabilities.

· Smart contracts are subject to coding errors, exploits, bugs, or other unforeseen issues that may result in loss, theft, or permanent locking of digital assets.

· NadFun is not responsible for losses arising from blockchain network failures, technical issues, or smart contract malfunctions.

· By using the Services and Interface, you acknowledge that blockchain technology is experimental and may be subject to sudden changes or failures.

3. Technical and Security Risks

· Unauthorized access, hacking, phishing attacks, malware, or other malicious activity may compromise your wallet, private keys, or account.

· You are solely responsible for securing your wallet, credentials, and private keys. NadFun does not store private keys and cannot recover lost or stolen digital assets.

· Network outages, software bugs, or other technical failures may temporarily prevent access to the Interface or Services, affect transactions, or result in loss of functionality.

· System failures, unplanned interruptions, hardware or software defects, security breaches or other causes, are unable to anticipate or detect, particularly the occurrences of hacks, cyber-attacks, mining attacks (including but not limited to double-spend attacks, majority mining power attacks and “selfish-mining” attacks), distributed denials of service or errors, or vulnerabilities or defects in the Interface. NadFun may not be able to detect such issues in a timely manner, and may not have sufficient resources to efficiently cope with multiple service incidents happening simultaneously or in rapid succession.

· There can be no assurance that cyber-attacks, such as distributed denials of service, will not be attempted in the future, and that any of such security measures will be effective. NadFun do not provide any assurances or make any representations whatsoever as to the usability, stability and security of the Interface and your assets.

4. Regulatory and Legal Risks

· Digital assets and blockchain-based services may be subject to laws and regulations that vary across jurisdictions. Access to or use of the Interface may be restricted or prohibited in certain countries.

· You are responsible for complying with all applicable laws and other regulatory obligations.

· Changes in laws, regulations, or governmental policies may adversely affect the value, usability, or legality of digital assets or services on the Interface.

5. Third-Party Risks

· The Interface and Services may provide links to third-party services, exchanges, wallets, or content. NadFun does not control these third parties and is not responsible for any losses arising from their services, errors, or malfunctions.

· Participation in activities involving third-party platforms or services carries additional risks that you must assess independently.

· Interactions with third-party platforms may result in loss of digital assets, data, or access, and NadFun is not liable for such outcomes.

6. Platform Risks

· The Interface may update, modify, or suspend certain features, services, or digital assets without prior notice.

· System failures, transaction delays, or software updates may temporarily impact the ability to access or use the Interface.

· NadFun is not responsible for losses caused by temporary or permanent disruptions to Interface.

· The Interface or the Services may be interrupted, suspended or delayed due to acts of God, natural disasters, wars, terrorist attacks, riots, civil commotions, widespread communicable diseases and other events beyond our control. Such events could also lead to uncertainty in the economic outlook of global markets and there is no assurance that the Interface will not be affected. In such events, the market price and the demand for your crypto assets may also be materially affected.

7. No Guarantee of Profit or Success

· NadFun makes no representations or warranties regarding the profitability, reliability, or performance of the Interface, tokens, or related services.

· There is no assurance that any transaction, investment, or activity conducted on the Interface will result in profit or success.

· All activities on the Interface are undertaken at your own risk, and NadFun does not provide financial or investment guarantees.

8. Acceptance of Risk

By using the Interface or Services, you expressly acknowledge and assume all risks described in this Risk Disclosure, including but not limited to:

· The risk of total loss of your digital assets, funds, or tokens.

· The risks associated with blockchain networks, smart contracts, and decentralized infrastructure.

· Technical, operational, regulatory, and third-party risks.

· Market volatility and financial risks.

You confirm that you understand these risks and voluntarily choose to use Interface and Services. By proceeding, you acknowledge that your use of the Interface is entirely at your own risk.
